Dr A

“Dr A” raised concerns about bearded male patients who identify as women being placed on female-only psychiatric wards. Instead of addressing her objections, her NHS Trust turned on her for simply pointing out the reality of biological sex.

What’s at stake?

  • Medical professionals should not be discriminated against for acting in accordance with biological reality.
  • Biologically male staff members, who identify as women, could be put forward to provide intimate same sex care to female patients.
  • NHS Trust’s Sexual Safety Policy could result in an assault by a biological man who identifies as a woman being recorded as female-on-female violence, preventing accurate monitoring and scrutiny.

Timeline:

2023

  • Throughout the year Dr A raises concerns that the Trust’s policies compromise the safety, dignity, and privacy of female patients and staff.
  • October: The Trust’s Delivering Single-Sex Accommodation policy is last updated, stating transgender patients should be accommodated according to their presentation, explicitly applying to toilet and bathing facilities.

2024

  • January: Dr A emails the Trust’s Head of EDI with a formal complaint about “factually incorrect and misleading” mandatory training.
  • Six weeks later: Dr A chases up the complaint via email. The Head of EDI receives the emails but never responds.

2025

  • 16 April: The Supreme Court unanimously rules that “sex”, “woman”, and “man” in the Equality Act 2010 refer to biological sex.
  • 17 April: The Trust reportedly tells staff there will be no immediate changes for patients.
  • May: Dr A raises concerns about using women’s toilets at Trust HQ. A senior colleague offers to guard the entrance; Dr A finds this offensive and is advised to use gender-neutral toilets instead.
  • June: Dr A lodges a formal grievance over the Trust’s alleged failure to implement the Supreme Court ruling.
  • Autumn: The Trust partially upholds the grievance. The panel recommends reviewing policies, setting timescales, clarifying the distinction between sex and gender, and reviewing the Transitioning at Work policy.

2026

  • Early in the year: The Trust largely dismisses Dr A’s appeal but agrees to some actions, including a Trust-wide statement on facilities, explanatory notes for policies, and clearer toilet provision information. It declines to set firm deadlines for wider policy review.
  • 6 August: Dr A alleges that most agreed actions remain outstanding, with no Trust-wide statement issued and no key policies revised.
  • 12 August: The Delivering Single-Sex Accommodation policy remains unchanged.
